LODGING
AGREEMENT 1. Introduction: The
owner(s) of the property in which you will be staying (the "Owner"),
by Vantage Resort Realty of Maryland, LLC, as agent ("Vantage Resort
Realty"), in consideration of the payment provided herein, hereby grants a
revocable license for weekly lodging to the person referenced above (the
"Guest") in a vacation property to be assigned to Guest (the
"Property") for the specified time referenced above. All information stated above is a part of this
Lodging Agreement, as are the following additional terms and conditions. In
entering into this Lodging Agreement, Vantage Resort Realty is acting on behalf
of Owner, as agent, and not on behalf of Guest. 2. Occupants: The property owners, whom we represent,
have instructed us to rent to family groups only. Non-family, non-chaperoned,
high school or college groups are not permitted. In addition, the number of occupants shall not
at anytime exceed the maximum limit set. Violation of these policies can result in
denial of access to the property, cancellation of the reservation and/or
immediate removal from the property without refund. 3. Check-In: A. Guests Staying at
Belmont Towers: Check-in Time is 3:00
p.m. on the first day of the lodging period.
Guests shall check-in at the Belmont Towers onsite vacation rental
office (Vantage Resort Realty) located at 2 Dorchester St, Ocean City, MD
21842. Keep in mind, however, that cleaning
of the Property may not begin until 7:00 p.m. Guest should check-in no later than 5:00 p.m. Late arrivals must call in advance to make the
necessary arrangements. If Guest has not
checked-in within 24 hours of arrival date, and other arrangements have not
been made, the reservation may be canceled and all rental fees will be
forfeited. B. Guests
Staying at all Other Properties: Check-in
Time is 3:00 p.m. on the first day of the lodging period. Guests shall check-in at the offices of
Vantage Resort Realty located at 5200 B Coastal Highway, Ocean City, Maryland
21842. Keep in mind, however, that cleaning
of the Property may not begin until 7:00 p.m. Guest should check-in no later than 5:00 p.m. Late arrivals must call in advance to make the
necessary arrangements. If Guest has not
checked-in within 24 hours of arrival date, and other arrangements have not
been made, the reservation may be canceled and all rental fees will be
forfeited. 4. Check-Out:
A.
Guests Staying
at Belmont Towers: Check-out time is
10:00 am on the day of departure. All
keys, pool passes, and parking passes must be returned to Belmont Towers onsite
vacation rental office (Vantage Resort Realty) located at 2 Dorchester St,
Ocean City, MD 21842. Guest is
responsible for the Property until all keys have been returned to Vantage
Resort Realty. All personal items belonging
to Guest must be removed from the Property prior to check-out. This includes boat trailers and vehicles
parked on the parking lot. If guest has
not returned keys to office by 10:00 am on the day of departure, guest will be
charged $20.00 for every 30 minutes late beginning at 11:00 am. Credit card on
file will automatically be charged. B.
Guests Staying
at all Other Properties: Check-out
time is 10:00 am on day of departure. All
keys, pool passes, and parking passes must be returned to the office of Vantage
Resort Realty at 5200 B Coastal Highway, Ocean City, Maryland 21842. Guest is responsible for the Property until
all keys have been returned to Vantage Resort Realty. All personal items belonging to Guest must be
removed from the Property prior to check-out. This includes boat trailers and vehicles
parked on the parking lot. If guest has
not returned keys to office by 10:00 am on the day of departure, guest will be
charged $20.00 for every 30 minutes late beginning at 11:00 am. Credit card on
file will automatically be charged. 5. Payment:
The remaining balance after payment of the reservation fees and
related expenses at the time of booking shall be due and payable no later than
thirty (30) days prior to Guest’s scheduled check-in date. Guest must contact Vantage Resort Realty prior
to that date with Guest’s preferred payment information. If Guest fails to contact Vantage Resort
Realty prior to thirty (30) days prior to Guest’s scheduled check-in, the
credit card on file with Vantage Resort Realty will automatically be charged
remaining balance. 6. Duty to Return Signed Lodging
Agreement: Guest’s failure to return
this Lodging Agreement signed within ten (10) days after booking may result in
cancellation and cancellation fees will apply. 7. Pets:
Pets are not permitted on the Property at any time. Any violation of this restriction is grounds
for immediate removal and forfeiture of all money paid. Additional cleaning fees may be charged in the
event of Guest’s violation of this section. 8. Damage to Property: Guest must surrender the Property at the end
of the lodging period in as good condition as the Property was in at the
beginning of the lodging period, normal wear and tear excepted. Guest is responsible for all damage to the
Property caused by Guest, Guest's family, and/or other invitees. Guest's credit card on file will be charged
for any missing or damaged items that are not covered under Security Deposit
Protection Plan which offered below in Section 22. This includes any missing or damaged linens if
guest chooses to rent linens. Vantage
Resort Realty and Owner(s) may inspect and make repairs to the Property during
the lodging period and will inspect the Property at the end of the lodging
period. Toilets shall not be used for
any purpose other than that for which they were constructed and no trash,
sanitary pads, diapers, rags or other garbage shall be placed therein. Any clog of sewer lines through the misuse or
neglect of Guest shall be repaired at Guest's expense. Guest will be responsible for any water or
other damage caused by a violation of this provision or any intentional misuse
of the toilets or other plumbing fixtures. 9. Equipment Malfunction: Vantage Resort Realty will endeavor to
address any equipment malfunction promptly on behalf of Owner (such as
televisions, VCRs, microwaves, etc.). Guest
will not be entitled to any refund as a result of the malfunction of such
equipment, however, even if a repair or replacement is not available. 10. Liability for Personal Injuries and Property Damage: Vantage Resort Realty and Owner(s) are
not responsible for any personal injury or property damage resulting from any
act of Guest in connection with Guest's use of the Property or any equipment
provided with the Property. 11. Compliance With Ocean
City’s Noise Control Ordinance: Ocean
City has adopted a Noise Control Ordinance that makes it unlawful to cause or
permit noise levels that exceed those established by the Department of Health
and Mental Hygiene of the State of Maryland (COMAR 10.20.01). It shall be a violation of this Lodging
Agreement and grounds for immediate eviction if these noise levels are exceeded
as a result of any action by Guest or Guest's family or other invitees on the
Property. Ocean City's noise ordinances
provide for civil and criminal penalties. 12. Lockouts: There will be a $50.00 fee for lockouts
that must be responded to during hours that the Vantage Resort Realty office is
closed. The fee will be payable when
Guest is admitted to the Property or automatically charged to the credit card
on file. 13. Pool Hours: Opening and
closing of pools is at the discretion of each individual building. Neither the Owner nor Vantage Resort Realty is
responsible for the hours that any pool is opened or closed or for the
condition of any pool. Guest is not
entitled to any partial or full refund if pool is not open. 14. Guest’s Personal
Property: Guest's personal
belongings left in the Property after Guest has vacated the Property may be
disposed of in any manner without Owner or Vantage Resort Realty’s liability. Owner and Vantage Resort Realty are not
responsible for theft of Guest's property unless determined to be committed by
employees of Vantage Resort Realty. 15. Responsibilities of Guest: The
person reserving this property must be the person checking in, or Vantage
Resort Realty has the right to refuse occupancy and treat this reservation as a
cancellation and retain deposit. The
property must be occupied by the Guest identified herein and all occupants of
the premises shall be supervised by that Guest for the entire duration of the
rental period. Guest agrees that this
Lodging Agreement may not be assigned or the property sublet for any reason. Violation of this provision shall be grounds
for immediate removal. 16. Parking
Restrictions: Some properties have
parking height restrictions. Vantage Resort Realty is not responsible if
guest's vehicles do not fit in parking garage. Please contact a representative
for height restriction of specific properties. A. Guests Staying at
Belmont Towers: Please note that
Belmont Towers Garage has a maximum height restriction of 6 feet, 7 inches. 17. Additional Fees: Please be advised that some vacation
properties have location-specific registration, pool or amenity fees. Please refer to the Property-specific Terms
and Conditions that was emailed to Guest along with confirmation of Guest’s
reservation confirmation for more information concerning these fees. Unless otherwise noted in writing, Guest shall
be responsible for the payment of any and all fees. 18. Rental of Linens and Other Rental Products: Guest has option of renting linens and
other rental products through Vantage Resort Realty (including cribs, boogey
boards, umbrellas, etc.) Vantage Resort
Realty does not provide linens and rental products but arranges such rentals
through third-party provider. If
products are not provided or not provided in a timely manner, Vantage Resort
Realty will work diligently to assist Guest in procuring rental products. In such an event, this Lodging Agreement shall
remain in full force and effect, however, and Guest shall still be responsible
for lodging portion of reservation. 19. Special Events: Vantage
Resort Realty is not responsible for any events, special functions or
conventions that may inconvenience Guest.
Please consult with town of Ocean City prior to booking reservation to
ensure such events do not interfere with your stay. 20. Entire Agreement: No representations, agreements,
undertakings, and/or promises, whether oral, implied, or inferred, have been
made by either Owner or Vantage Resort Realty unless expressly stated herein,
and this Lodging Agreement represents the parties’ entire agreement. 21. Security Deposit
Protection Plan: A Security Deposit
Protection Plan is available to cover unintentional damage to the interior of
the Property that occurs during Guest’s stay, provided such damage is disclosed
to Vantage Resort Realty no later than Guest’s check-out. The plan will cover a maximum damage amount of
$1,500. Any damages that exceed $1,500
will be charged to the Guest's credit card on file. Full details of the Security Deposit
Protection Plan are contained in a separate Certificate of Insurance or
Insurance Policy. The Security Deposit
Protection Plan can be purchased up to, and including, the date of Guest’s check-in.
By submitting payment for this plan,
Guest authorizes and requests CSA Travel Protection and Insurance Services to
pay directly to Vantage Resort Realty any amount payable under the terms and
conditions of the Security Deposit Protection Plan. Please contact Vantage Resort Realty directly
if you wish to participate in this plan.
Please click here

certificate of insurance for your Security Deposit Protection plan if you have
paid for or authorized payment for the plan. If purchased, the plan includes protection
against accidental damage to your rental accommodations during your stay. If you have to cancel and don't get a chance
to check in, the cost of the plan will be returned to you. 22. Care and Maintenance of
Property: Guest is responsible for
maintaining the cleanliness of the Property during occupancy and to leave the
premises reasonably neat and in good condition upon departure. This includes removing any food or drink from
the refrigerator and cabinets, washing the dishes and putting them back in the cabinets,
removing all trash from inside the unit and depositing same into the dumpster,
and keeping the carpets and floors in a “broom-swept condition” free of
excessive debris. Failure to return the
premises in reasonably good condition will result in an excess cleaning fee of
$200 or more, depending on the severity of the conditions the premises were
left. Guest's credit card on file will
automatically be charged. 23. Governing
Law; Jurisdiction; Venue: The parties hereto agree that this
Lodging Agreement is made in and shall be governed by, construed and enforced
in accordance with the laws of the State of Maryland. The parties further
agree that any legal action brought by either party arising out of this Lodging
Agreement or to enforce this Lodging Agreement shall be brought in Anne Arundel
County, Maryland (the location of Vantage Resort Realty’s principal office) or
the federal courts situate in Maryland. The parties hereto each
specifically consent to personal jurisdiction and venue in such courts.
In the event of any default or breach of any condition hereof, Guest shall be
liable to Owner and/or Vantage Resort Realty for any money expended for
reasonable attorney’s fees or other costs which may be incurred on behalf of
Owner and/or Vantage Resort Realty in remedying said default. 24. Travel Insurance: Guest has the option of including
CSA Vacation Rental Insurance in this reservation. This provides reimbursement for unused,
nonrefundable payments if Guest's trip must be canceled or interrupted for a
covered reason. Covered reasons include:
mandatory hurricane evacuations; sickness, injury or death; extension of school
year; armed service leave revocation; involuntary termination of employment or
other specific reasons listed in the Policy/Certificate of Insurance. We strongly recommend you purchase this
valuable protection. By initialing
below, you are agreeing to purchase CSA Vacation Rental Insurance at a cost of
6.95% of all non-refundable charges on your reservation. Your reservation will be updated when we
receive this Lodging Agreement back and payment will be due at final payment. By initialing here I agree to purchase CSA
Travel Insurance at a cost of 6.95% of all non-refundable charges on my
reservation: . 26. Cancellations by Guest: A. Guests
Staying at Belmont Towers: In the
event Guest requests a cancellation of this Lodging Agreement, Vantage Resort
Realty will make every reasonable effort to re-rent the property. Under such circumstances: i. If Vantage Resort Realty is able to re-rent
this Property for the same dates of stay for the same amount or greater, Guest
will be entitled to a refund of all amounts paid under this Lodging Agreement, less
a $150 service charge (hereinafter referred to as a “Cancellation Fee.”); ii. If Vantage Resort Realty is able to
re-rent this Property for the same dates of stay, but only for a lesser amount,
Guest will be entitled to a refund of all amounts paid under this Lodging
Agreement, less the $150 Cancellation Fee, and less the difference between the
amount of the original booking and the amount for which Vantage Resort Realty
was able to re-rent the property; and iii. If
Vantage Resort Realty is unable to re-rent this Property for the same dates of
stay, Guest will forfeit the full rental amount called for under this Lodging
Agreement. No Refund will be given for
inclement weather, including hurricanes or other acts of nature. For this reason, Vantage Resort Realty
strongly suggests that Guest purchase Travel Insurance which is offered
below. B. Guests
Staying at all Other Properties: In
the event a Guest requests a cancellation of this Lodging Agreement, Vantage
Resort Realty will make every reasonable effort to re-rent the property. Under such circumstances: i. If
Vantage Resort Realty is able to re-rent this Property for the same dates of
stay for the same amount or greater, Guest will be entitled to a refund of all
amounts paid under this Lodging Agreement, less a penalty of sixteen percent (16%)
of the total amount due under this Lodging Agreement, and less Vantage Resort
Realty’s prevailing processing fee, as referenced on receipt for this
transaction (hereinafter the “Processing Fee”); ii. If
Vantage Resort Realty is able to re-rent this Property for the same dates of
stay, but only for a lesser amount, Guest will be entitled to a refund of all
amounts paid under this Lodging Agreement, less a penalty of sixteen percent (16%)
of the total amount due under this Lodging Agreement, less the Processing Fee,
and less the difference between the amount of the original booking and the
amount for which Vantage Resort Realty was able to re-rent the property; and iii. If
Guest requests a cancellation of this Lodging Agreement thirty (30) days or
more in advance of the scheduled Check-In date, and Vantage Resort Realty is
unable to re-rent this Property for the same dates of stay, Guest will forfeit
one-third (1/3) of full rental amount called for under this Lodging Agreement,
plus the Processing Fee. If, however,
Guest requests a cancellation of this Lodging Agreement less than thirty (30)
days in advance of the scheduled Check-In date, and Vantage Resort Realty is
unable to re-rent this Property for the same dates of stay, Guest will forfeit
the full rental amount called for under this Lodging Agreement. No Refund will be given for
inclement weather, including hurricanes or other acts of nature. For this reason, Vantage Resort Realty strongly
suggests that Guest purchase Travel Insurance which is offered below in Section
24. By signing below, I agree to the terms and conditions of
